Terms of Service

The short version

Xuna is a cold-email tool. Use it for legitimate outreach — to people you have a reason to contact. Don't use it to spam, harass, scrape, or break the law. Pay for the plan you're on. Don't try to break things. That's about it. The legal version is below.

Agreement

By creating an account or using Xuna ("the Service"), you agree to these Terms. If you don't agree, don't use the Service.

"We", "us", "Xuna" — Xuna Cold Mailer.
"You" — the person or company using the Service.

Accounts

  • You must be at least 18 to use Xuna.
  • You sign in with Google. You're responsible for keeping your Google account secure.
  • You're responsible for everything that happens under your account — including emails sent from it.
  • One person, one account. Don't create multiple accounts to evade limits or bans.
  • You can delete your account from Settings at any time.

What you can use Xuna for

Xuna is for sending cold outreach emails — to leads, prospects, journalists, hiring candidates, partnership targets, investors, etc. — where you have a legitimate, lawful business reason to contact the recipient.

What you cannot use Xuna for

We will terminate accounts that do any of the following without warning:

  • Spam — sending unsolicited bulk email to recipients who have no plausible reason to hear from you.
  • Buying scraped or sold lists and uploading them. We can't detect this in every case, but if your bounce rate or spam complaint rate spikes, we'll find out.
  • Sending to addresses that have unsubscribed from you on this platform.
  • Phishing, fraud, impersonating someone you aren't, or pretending to be a different brand.
  • Sending adult content, hate speech, harassment, threats, or illegal content.
  • Promoting illegal goods or services in the recipient's or sender's jurisdiction.
  • Trying to break, probe, scrape, reverse engineer, or DDoS the Service.
  • Reselling Xuna to others without our written permission.
  • Bypassing or attempting to bypass quotas, billing, or feature gates.

Anti-spam compliance is your responsibility

You must comply with the anti-spam laws that apply to you and your recipients — including CAN-SPAM (US), GDPR (EU), PECR (UK), CASL (Canada), Spam Act (Australia), and any others.

Xuna includes tooling to help you comply (unsubscribe links on every email, honoring of opt-outs, suppression list, bounce monitoring), but the legal responsibility is on you to use the service lawfully.

Plans, billing, and refunds

  • Free tier: no card required, capped at 149 emails per month.
  • Paid plans (Starter / Growth): monthly subscription billed via Razorpay. Prices are shown on the pricing page and are inclusive of taxes where required.
  • Plans renew automatically on the same day each month.
  • You can cancel from Settings at any time. You keep access until the end of the current period.
  • Refunds: we don't offer prorated refunds for partial periods. If you believe you've been wrongly charged, email us and we'll work it out fairly.
  • If a payment fails, we may suspend paid features until it succeeds. Free tier remains available.
  • We may change prices with at least 30 days' notice. Your existing subscription stays at its current price until renewal after that period.

Service limits and acceptable use

  • Quotas (emails, AI personalizations) are enforced per billing period and reset monthly.
  • Going over a quota blocks further use of that feature until the next period or until you upgrade.
  • We may rate-limit suspicious activity even if you're under your quota.
  • We reserve the right to throttle, suspend, or terminate accounts whose bounce rate, complaint rate, or unsubscribe rate exceeds healthy thresholds, to protect everyone else's deliverability.

Your content vs our service

Your content — the prospects you upload, the templates you write, the emails you send, the replies you receive — is yours. You own it. We get a limited license to host and transmit it to run the Service for you, and that\'s it.

Our service — the Xuna code, design, brand, templates we ship in the library, AI prompts, and everything else we built — is ours. You get a limited, non-transferable, non-exclusive license to use it as part of using the Service. You don\'t get to copy, white-label, or resell it.

Third-party services

Xuna relies on third parties (Google, OpenAI, Resend, Razorpay, Supabase, Vercel, Upstash). Their terms apply when you use their parts of the stack:

  • When you connect Gmail, you're also subject to Google's API terms.
  • When you pay, you're also subject to Razorpay's terms.
  • When AI personalises an email, OpenAI's usage policies apply to the content sent.

We pick reputable vendors and they\'re unlikely to surprise you, but we don\'t control them.

Termination

You can terminate by deleting your account.

We can terminate or suspend your account if you violate these Terms — including the "what you cannot use Xuna for" list above. Where possible we\'ll warn you first and give you a chance to fix it, but we don\'t have to for severe violations (spam, fraud, illegal content). On termination, your data is deleted per the Privacy Policy retention schedule.

No warranty

Xuna is provided "as is" and "as available". We don\'t warrant that the Service will be uninterrupted, error-free, or perfectly accurate. AI-generated content can be wrong, weird, or unsuitable — review every email before you send it.

We aim for 99% uptime but don\'t guarantee it. If we go down, we go down.

Limitation of liability

To the maximum extent allowed by law:

  • Xuna is not liable for indirect, incidental, consequential, special, or punitive damages.
  • Our total liability to you for any claim in any 12-month period is capped at the amount you paid us in the previous 12 months (or US$50, whichever is greater).
  • We are not liable for problems caused by your use of the Service to violate the law — including penalties imposed on you for spam, GDPR, or similar.

Some jurisdictions don\'t allow some of these limitations. In those places, the limitations apply to the maximum extent permitted.

Indemnification

You\'ll defend and indemnify Xuna against any third-party claim arising out of your use of the Service in violation of these Terms or any law — including spam complaints, GDPR enforcement, and similar.

Changes to these terms

We may update these Terms. Material changes will be announced via email and posted here at least 14 days before they take effect. Continued use after that is acceptance. If you don\'t agree, your remedy is to stop using the Service before the change date.

Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute that can\'t be resolved amicably will be brought exclusively before the courts of Mumbai, India — unless a mandatory law in your country requires otherwise.
